"Angry over their children’s Harlem charter school getting the boot from
its free public space, parents plan to file a federal lawsuit against
the city, a source told the Daily News.
Parents of students at Success Academy Harlem Central Middle School
contend the city’s decision violates their children’s constitutional
right to adequate education.
The suit is expected to be filed as soon as Monday.
Under the Bloomberg administration, three Success Academy charter
schools were approved for co-locations with public schools for the next
school year.
Mayor de Blasio revoked the city’s offer of free classrooms for Success
Academy Harlem Central last week, arguing it would displace crucial
programs for disabled students.
“The administration is already taking steps to resolve concerns we have
received by some parents,” said a Department of Education spokesman.
“In our decisions, we set consistent, objective, common-sense standards
— most importantly protecting students with disabilities,” the
spokesman said. “We remain deeply committed to the rights of all
students, and ensuring every child has access to a great education.”
Harlem Central is already open, and the decision would displace nearly
200 students. The other two schools were set to open next school year.
In addition to the federal suit, parents are filing two complaints with
the state education commissioner challenging the city’s decision."
