EPA freely admits its ban on new coal plants will have no effect on CO2 emissions, page 346, Sept. 20, 2013 document submitted to Fed. Register. Over to you Zack Colman at Washington Examiner

Sept. 20, 2013, Environmental Protection Agency, “Standards of Performance for Greenhouse Gas Emissions from New Stationary Sources: Electric Utility Generating Units Proposed Rule.” Submitted “for publication in the Federal Register” (p. 1)

.
scroll to page 346, item E.:
  • E. “What are the economic and employment impacts?”
“The EPA does not anticipate that
this proposed rule will result in notable
CO2 emission changes, energy impacts,
monetized benefits, costs, or economic impacts by 2022.
The owners of newly built electric generating units
will likely choose technologies that meet these standards
even in the absence of this proposal due to existing economic
conditions as normal business practice. Likewise, the EPA
believes this rule will not have any impacts on the price
of electricity, employment or labor markets, or the U.S. economy.
As previously stated, the EPA does not anticipate that the
power industry will incur compliance costs as a result of this
proposal and we do not anticipate any notable
CO2 emission changes resulting from the rule.
Therefore, there are no direct monetized climate
benefits in terms of CO2 emission reductions
associated with this rulemaking. However, by clarifying
that in the future, new coal-fired power plants will be
required to meet a particular performance standard, this
rulemaking reduces uncertainty and may enhance the prospects
for new coal-fired generation and the deployment of CCS,
and thereby promote energy diversity.” (end page 346)

'US Dept. of Health and Human Services known for its lax oversight has paid out billions of dollars on phony Medicare HIV therapy claims,' Miami Herald

.
11/2/13, "FBI tracking down Medicare fraud fugitives from South Florida," Miami Herald, Jay Weaver

"In Miami’s very deep sea of Medicare fraud, Carmen Gonzalez was a minnow. So when federal agents recently nabbed her after five years on the lam, it didn’t exactly make a splash. But her arrest was the latest in an under-the-radar round-up of fugitive scammers who have branded Miami with the dubious title of the nation’s capital of healthcare corruption.

Gonzalez had played a supporting role in one of the region’s biggest, baddest Medicare rip-offs. She first worked as a cleaning lady, and then as a nurse who paid kickbacks to patients, for the notorious Benitez brothers — three sharks who ran 11 Miami-Dade clinics that swindled a staggering $84 million from the taxpayer-funded program, authorities say.

In the spring of 2008, Gonzalez and her father, Enrique, who also worked for the Benitez brothers, fled Miami after they were separately charged. The brothers — Carlos, Luis and Jose — also left Miami soon after they were indicted that May.

Where did they all go? Cuba — No. 1 among Latin American destinations of choice for South Florida’s Medicare fraud fugitives. Together, they stole hundreds of millions of dollars by filing billions in false claims for everything from medical equipment to HIV-therapy infusion drugs.

Gonzalez and some 30 other defendants have been captured over the last half-dozen years, with the pace of arrests beginning to pick up this year. There are still another 150 fugitives from outstanding Medicare fraud cases in South Florida, most of them Cuban-born immigrants who fled to Cuba, Mexico, the Dominican Republic and other Spanish-speaking countries to evade federal trials. View more of the fugitives in our database.

With the exception of Cuba, several foreign countries with U.S. extradition treaties have assisted federal authorities with making arrests and returning fugitives to the United States.

Though progress has been plodding, agents have collared 10 fugitives this year alone, compared to a previous pace of one every couple of months, said Randall Culp, the FBI special agent who supervises healthcare fraud investigations in South Florida.

“We’ve been whittling down the number on a case-by-case basis,” Culp said. “Agents are persistent in trying to locate the fugitives and eventually law enforcement catches up with them.”
“Sometimes we just get lucky.”

In September, for example, FBI agents caught up with Gonzalez, a cousin of the Benitez brothers, after she had sneaked back into this country through the Mexican border. She made the mistake of reapplying for a Florida driver’s license while living in the Fort Myers area with relatives.

In mid-October, she found herself dressed in an orange inmate jumpsuit, standing in the courtroom of U.S. District Judge Federico Moreno — the very judge she had blindsided five years earlier when she jumped bail, fleeing the country after the judge had granted her a $50,000 bail when she asked to visit Disney World for her son’s birthday. The Orlando trip turned out to be a ruse.

“Where did you go? Why didn’t you show up in court?” Moreno asked Gonzalez, before she pleaded guilty to a bond-jumping charge last month. “I went to Cuba,” answered Gonzalez, who now goes on trial for Medicare fraud in December.

Gonzalez’s defense attorney, Joel DeFabio, said she “panicked” in May 2008 when she fled with her son and husband.

“She found that life in Cuba was hard, especially for her son,” said DeFabio. “She saw no future in Cuba and wanted to give her son a better life, so she returned to the United States.”

At the time of her initial arrest, Justice Department prosecutors had warned that Gonzalez — charged in an $11 million Medicare fraud scheme at one of the Benitez brothers’ clinics, St. Jude Rehab Center, and suspected of assisting eight of their other HIV-therapy clinics in the Miami area —was a flight risk. They also noted that her father, also charged as a bookkeeper and patient recruiter at two Benitez brothers’ clinics, had just fled the country.

Moreno, the court’s chief judge, had himself just issued a memo in 2008 warning his colleagues not to set low bonds for Medicare fraud defendants, citing a rising increase in fugitives.

So the judge was not amused when Gonzalez forfeited a $7,500 bond down payment, and didn’t show up for her next hearing that June. The judge lamented that Cuban immigrants were coming to the United States, gaining lawful residency and stealing from the Medicare system — and then returning to their native country with ill-gotten gains.

“It seems to me that our thinking has to change — that someone from Cuba can flee back to Cuba just like someone from Mexico,” Moreno told Gonzalez’s attorney, DeFabio, at the time. “I don’t know what your client’s situation is, but money goes a lot farther in Cuba.”

Despite those cautionary words, the pattern of South Florida’s Medicare offenders fleeing to Cuba, Mexico and other Latin American countries continued to climb until judges in the last few years began rejecting bond requests before trial....

An example: In 2009, Alcides Garcia, wanted for his role in a $10.7 million medical equipment ring, went to a shipping company in the Canary Islands to have his personal belongings sent from Miami to the Spanish island off the northwestern coast of Africa.

Garcia kept saying he was Mexican, but his heavy Cuban accent was a dead giveaway.

So, the shipping company owner Googled Garcia’s name and up popped a Miami Herald/El Nuevo story published in January 2009 that described Garcia as a Cuban-born fugitive wanted on Medicare fraud charges in South Florida. The story, which carried a mug shot of Garcia, confirmed his identity.

The owner called the FBI in Miami with an anonymous tip, and the Spanish National Police did a background check and arrested him on a provisional federal warrant at a hotel in Madrid. Garcia, 49, who had used his real name but a false Mexican passport, was eventually sentenced to eight years in prison.

The bureau also has had success dealing with other foreign countries. Last February, for example, Colombian authorities extradited a woman who had walked out of her 2006 healthcare fraud trial in Miami just before the jury convicted her of operating a $5 million HIV-therapy racket.

In 2012, the FBI caught up with Magda Luz Lavin after Colombian authorities received a complaint about her from the victims of a business scam in her native country, who had heard she was wanted back in Miami on healthcare fraud. She was arrested that June in Medellin and later extradited from Bogota to Miami. Lavin, 55, was sentenced to 15 years in federal prison....

During the past decade, HIV-therapy exploded into the most spectacular swindle in Medicare history, with Health and Human Services, known for its lax oversight, paying out billions of dollars on phony claims for obsolete drug treatments that were mostly not provided to patients. The scam spun so out of control that Medicare-licensed clinics in South Florida billed more for this bogus therapy — more than the rest of the country combined.

For the Benitez brothers, the HIV-therapy scheme was a windfall: Medicare paid their clinics about $84 million between 2001 and 2004, according to their indictment.

The Benitezes, who came to this country in 1995 and became U.S. citizens five years later, have now found a safe haven in Cuba, according to sources familiar with their status. The FBI cannot pursue them or any other fugitives in Cuba because the United States does not have normal relations with the communist island nation."...via Michael Savage

At unlikely moment a 40 foot statue of Jesus Christ has risen in Syria, project begun in 2005, Russia among backers

.
11/2/13, "In midst of Syrian war, giant Jesus statue arises," AP, Beirut

"In the midst of a conflict rife with sectarianism, a giant bronze statue of Jesus has gone up on a Syrian mountain, apparently under cover of a truce among three factions in the country's civil war.

Jesus stands, arms outstretched, on the Cherubim mountain, overlooking a route pilgrims took from Constantinople to Jerusalem in ancient times. The statue is 40 feet tall and stands on a base that brings its height to 105 feet, organizers of the project estimate.

That the statue made it to Syria and went up without incident on Oct. 14 is remarkable. The project took eight years and was set back by the civil war that followed the March 2011 uprising against President Bashar Assad.

Christians and other minorities are all targets in the conflict, and the statue's safety is by no means guaranteed. It stands among villages where some fighters, linked to Al Qaeda, have little sympathy for Christians.

So why put up a giant statue of Christ in the midst of such setbacks and so much danger? Because "Jesus would have done it," organizer Samir al-Ghadban quoted a Christian church leader as telling him.

The backers' success in overcoming the obstacles shows the complexity of civil war, where sometimes despite the atrocities the warring parties can reach short-term truces....

Russians have been a driving force behind the project -- not surprising given that the Kremlin is embattled Assad's chief ally, and the Orthodox churches in Russia and Syria have close ties.

Al-Ghadban, who spoke to The Associated Press from Moscow, is Syrian-Russian and lives in both countries.

Al-Ghadban said he began the project in 2005, hoping the statue would be an inspiration for Syria's Christians. He said he was inspired by Rio de Janeiro's towering Christ the Redeemer statue. [below]

He commissioned an Armenian sculptor, but progress was slow.  A series of his backers died, including Valentin Varennikov, a general who participated in the 1991 coup attempt against then President Mikhail Gorbachev. He later sought President Vladimir Putin's backing for the statue project. Varennikov died in 2009.

Another backer, Patriarch Ignatius IV, the Lebanon-based head of the Greek Orthodox Church of Antioch and All the East, died in 2012. He had donated the land for the statue, according to church official Bishop Ghattas Hazim.

By 2012, the statue was ready, but Syria was aflame, causing the project's biggest delay, al-Ghadban said."...top image above from AP article via Fox News, 2nd image also from AP but from another publication, via Lucianne

Car featured in final airport scene of 1942 ‘Casablanca’ to be auctioned in New York

.
10/31/13, “Of all the cars in all the world… Convertible  that features in immortal Casablanca finale expected to fetch $500,000 at auction,” UK Daily Mail, Steve Nolan

“It features in one of the most famous movie scenes of all time – and now it could be yours.

casablancaairportscene
The car in which Humphrey Bogart and Ingrid Bergman’s characters travelled in to the airport for Casablanca’s immortal finale is going under the hammer next month. The 1940 Buick Phaeton – which belonged to Bogart’s character Rick Blaine in the 1942 film – is expected to fetch $500,000 (£312,000) at auction in New York on November 25.

It is among a number of iconic movie props and costumes being sold off as part of the Dreams Are Made of This auction at Bonhams.

CasablancaCarTodayUKDailyMailCaterNewsThis car looms large in the final act of Casablanca: Claude Rains as Captain Louis Renault drives the car to the airport at gunpoint, with Humphrey Bogart as Rick Blaine in the front, and Ingrid Bergman playinng Isla Lund and Paul Henried as Victor Laszlo in the back seat.

Throughout the final moments of the film, Rick, Ilsa, Victor and Louis linger on the airport tarmac next to the Buick Phaeton, and the film’s immortal final moments between Rick and Ilsa take place next to the car.

A QUICK BUICK: WHAT DO YOU GET FOR YOUR MONEY?

The 1940 Buick Phaeton Limited 81C convertible is expected to fetch $500,000 (£312,000) at auction. But what will you get for your money:

  • 8 cylinder engine
  • Manual transmission with left hand drive
  • Mileage around 42,000
  • Two bench seats, a brown exterior with rag top (replaced), original tan interior with some damage
  • The car has been mechanically restored with a new wiring harness
  • A copy of the DVD of the film and a reproduction still
The car can be seen in the background as Bogart looks into Bergman’s crying eyes and utters arguably the most famous movie quote of all time: ‘Here’s looking at you kid.’
.
Despite being 73-years-old the car, which as part of Warner Brother’s fleet it featured in several other films including High Sierra, also starring Bogart, only has 42,000 miles on the clock.

The car itself would be ultra-rare even if its wasn’t attached to Bogart’s star status.

Only 230 Buick Model 81C trunkback convertible Phaetons were built in 1940 – and similar Buicks from that time period have sold for around $500,000 (£311,000), so Bogart’s could go for higher.

The car was originally bought from Warner Brother’s by famed ukelele player Lyle Ritz in 1970 before being sold at auction twice since. It was last auctioned off in 1995.

The auction has been put together with television channel Turner Classic Movies.” (above color image of the car via UK Daily Mail), via Free Republic

Any delay of ObamaCare the tax must be scored by the Congressional Budget Office. To claim ObamaCare isn't a tax would make it unconstitutional and subject to new court challenge-USA Today op-ed

.
This matter isn't about Democrats, it's about John Boehner who has refused to hold an up or down standalone vote on ObamaCare the tax. All taxes must be approved by the House.

10/31/13, "Dems may have to admit Obamacare tax increase: Column," USA Today, Randy Barnett and Josh Blackman

"The individual insurance mandate can't be a requirement to buy insurance because that unprecedented demand was declared unconstitutional by the Supreme Court.

Instead, the court identified the mandate as a tax on millions of Americans. If that's true, it must be forthrightly identified as such and scored by the Congressional Budget Office....

When defending the law before the Supreme Court, the administration...insisted that the law did not compel people to purchase insurance. Solicitor General Donald Verrilli emphatically denied that there was an "entirely stand-alone" requirement to buy insurance. It was this concession by the administration that Chief Justice John Roberts used to save the law. Under Roberts' saving interpretation of the ACA, no one is required to purchase health insurance, so there is no mandate. There is only a tax on people who don't buy insurance. And, the Court said, that tax must be low enough to preserve the "choice" or option to not buy insurance. No one can be punished for being uninsured.

So if there is no longer any "individual mandate," then the Democrats are proposing to delay the tax that John Roberts wrote into the law, but which was never enacted by Congress. When the Affordable Care Act was written, Democrats deliberately labeled it a "penalty." Had the law been called a tax, the president could never have mustered the votes to pass it. As Senate Minority Leader Mitch McConnell noted, the tax-free ACA "was one of the Democrats' top selling points — because they knew it would have never passed if they said it was (a tax increase)."...

Any suspension of this tax must be scored by the Congressional Budget Office so the public knows the size of the tax increase that will be imposed on the American people when the delay ends and the tax kicks in....

(To) insist that the penalty is not a tax...will be admitting that it is unconstitutional under the Supreme Court's decision. If Congress contradicts what the administration told the Supreme Court, a new challenge can be brought under the precedent of NFIB v. Sebelius."...

=======================

Comment: This article is really about one person, John Boehner. All taxes must be approved by the House. The Supreme Court doesn't originate taxes, just decides their legality. GOP House Speaker Boehner has refused to hold a standalone vote in the House to approve ObamaCare the tax. This matter isn't a game of tag between two political parties. It's a life and death matter affecting the United States as a country. Then there are millions of people and billions of their tax dollars already misappropriated. John Boehner is the reason this article had to be written. ObamaCare is currently illegal. Not stated in the article is Boehner should resign or be impeached for failing his most basic constitutional duty. Boehner didn't want to have that vote so he simply declared ObamaCare is "the law of the land:"

Two days after Obama’s re-election John Boehner enthused that ObamaCare was “the law of the land” due to Obama’s re-election. ObamaCare isn’t the law of the land, isn’t legal to this day. Among other things, Mr. Boehner failed to hold a vote in the House up or down on ObamaCare as a tax.
“House Speaker John Boehner made it official Thursday: Obamacare isn’t going anywhere. In an interview with ABC News, Boehner seemed to suggest the election ended any efforts to wipe out the whole law. When “World News” anchor Diane Sawyer asked if there would be any more votes to repeal the law, Boehner said “the election changes that” and “Obamacare is the law of the land.””

Senator Mike Lee gets ten minute ovation in Utah today

.
11/2/13, "10 Minute Ovation Today for Senator Mike Lee in Utah (Video)," Breitbart, Debra Heine

"1,500 to 2,000 supporters of Senator Mike Lee, waving American flags and holding home-made signs, gave a ten minute ovation to their favorite Senator at a rally in Salt Lake City, Saturday morning, to counter the media narrative  that ‘his constituents don’t like him.’

Two "nasty protesters" were reportedly arrested.

The Salt Lake Tribune reported:
The Republican senator has taken a beating in recent weeks, not just from Democrats but members of his party for leading the fight — along with Sen. Ted Cruz, R-Texas — that forced a 16-day partial government shut down.
"I’ve read polls that said some people in Utah don’t like Mike Lee," organizer Amelia Powers told the crowd gathered at Riverfront West Park in South Jordan. "But I’m lucky to be from a place that has a senator like Mike Lee. He has represented Utah well."
Powers and a friend organized the rally in less than a week with the help of Facebook and Twitter. It attracted everyone from families with young children to senior citizens and veterans.""

'Furious' lobbyists lean on GOP 'leaders,' panicked GOP 'business side' goes on massive intimidation binge to silence all opposition. Having sold out the country and taken no actions that distinguish themselves from democrats they have no other choice

.
"Mr. McConnell’s allies in Washington’s lobbying community have been furious for weeks." (What's the big deal with lobbyists and the GOP? They can make more money with democrats).
.
11/1/13, "Republican Campaign Committee Pushes Back Against Conservative Group," NY Times Caucus blog, By Jonathan Martin (1:51pm)

"In a warning shot to outside conservative groups, the National Republican Senatorial Committee this week informed a prominent Republican advertising firm that it would not receive any contracts with the campaign committee because of its work with a group that targets incumbent Senate Republicans.

Even more striking, a senior official at the committee called individual Republican Senate campaigns and other party organizations this week and urged them not to hire the firm, Jamestown Associates, in an effort to punish them for working for the Senate Conservatives Fund, a group founded by Jim DeMint, then a South Carolina senator, that is trying to unseat Senator Mitch McConnell of Kentucky, the Republican leader, and some other incumbents up for re-election next year whom it finds insufficiently conservative.

“We’re not going to do business with people who profit off of attacking Republicans,” said Brad Dayspring, a spokesman for the committee. “Purity for profit is a disease that threatens the Republican Party.”

The committee has conveyed the same message, privately, to 2014 Senate candidates,

the Republican National Committee,

the National Republican Congressional Committee (the senatorial committee’s House counterpart),

the Republican Governors Association and

Mike DuHaime, the chief strategist for Gov. Chris Christie of New Jersey, for whom Jamestown also does work.

Jamestown declined to respond to the attempt to curtail their business, deferring to the Senate Conservatives Fund, which criticized Mr. McConnell.

“This is happening because Mitch McConnell is having a complete meltdown,” said Matt Hoskins, executive director of the conservative group. “He can’t defend his record so he’s threatening and attacking everyone who disagrees with him. He’s so rattled, he has decided to declare war on the entire conservative movement, which represents the very people he needs to win re-election. This isn’t the behavior of a confident person. It’s the irrational reaction of a power-hungry bully who isn’t getting his way.”

Some of Jamestown’s conservative clients also moved to defend the firm.

“When some in Washington stepped away from our campaign, Jamestown stood with us and fought,” said Representative Mark Sanford, Republican of South Carolina. “I think their team is a good one and what a few in D.C. decide isn’t going to change that.”

The National Republican Senatorial Committee’s power play is part of a larger effort among establishment Republicans after the recent government shutdown to seize control of the party from insurgent forces who want to push Republicans toward a more hard-line posture and aggressive brand of conservatism.* The attempt to effectively blacklist the consulting firm illustrates the extent of the tensions between the establishment and the hard-liners.

Mr. McConnell’s allies in Washington’s lobbying community have been furious for weeks that Jamestown, which also does work for groups like the Republican Jewish Coalition, was on retainer with the Senate Conservatives Fund.

One prominent Republican lobbyist even printed out the records of a Louisville television station detailing the run times of every ad devised by Jamestown for the conservative group’s campaign against Mr. McConnell and gave it to a reporter.

“These are not the kind of people we would ever do business with,” said Scott Reed, senior political strategist for the U.S. Chamber of Commerce.

In the wake of the shutdown, Mr. McConnell and his top aides are also becoming more outspoken about wanting to effectively destroy the Senate Conservatives Fund. The senator has told donors that he and other party leaders will take a much more aggressive approach in confronting such conservative groups.

And on Friday, one of Mr. McConnell’s closest aides offered a vivid metaphor about the leader’s determination.

“S.C.F. has been wandering around the country destroying the Republican Party like a drunk who tears up every bar they walk into,” said Josh Holmes, Mr. McConnell’s chief of staff, now detailed to the National Republican Senatorial Committee through the election. “The difference this cycle is that they strolled into Mitch McConnell’s bar and he doesn’t throw you out, he locks the door.”"
.
===================

Comment: This isn't about "conservatism," a word that has lost any meaning due to rampant misuse. It's about the theft of this country and that the GOP has merged with democrats. A one-party country means half the country is without representation in the Beltway. "Threatens the Republican Party?" What Republican Party? The Republican Party has been dead since before the 2006 midterms. The few remaining GOP after Nov. 2008 were happy just to be there and be left alone. In January 2009 McConnell himself said the GOP was becoming mainly a Southeast regional party. It's sick that someone who's been in office since 1984 (McConnell), who sat by and watched this country be destroyed and delivered to the radical left hasn't resigned in disgrace. Mitch McConnell was at the center of influence, information, and microphones for 8 years during George Bush. I could've told you people with no job couldn't pay a mortgage. McConnell allowed, did nothing to stop, and/or declined to alert millions of Americans about the upcoming destruction of lifetimes of work and sacrifice. He did nothing to stop the destruction of the Republican Party. Under his 'leadership' the country has been turned over to the radical left. He has never once apologized to us for his part in destroying the lives of so many Americans. He has never described what the GOP did wrong to cause this and what it's doing to make sure it will never happen again. McConnell is free to be a successful businessman, but he's very sick to believe he can combine his business interests with my life after proving over many, many years that I mean nothing to him. What exactly is the big deal about lobbyists and the GOP? Lobbyists can make all the money they want via democrats.

As if he had nothing to do with it, longtime GOP 'leader' McConnell describes in grisly detail for all the world to hear the pathetic failure of the GOP on his watch:

What word would you use to describe someone from party A (Republican) asking members of party B (Democrat) to vote down a member of party A (Republican) for supporting a fundamental view of party A?"...

=========================

Republican Party shows "nauseating deference" to Democrats and the media:

3/27/13, "Is the Republican Party America's Achilles Heel?" American Thinker, Steve McCann

"When they look to the leadership of the Republican Party they see a nauseating deference to the party in power and the media -- in other words business as usual in Washington.  Apparently the Republican Establishment believes it will eventually win when it is their turn if they just can find a way to bribe minorities, particularly Hispanics into voting for them....

It has become painfully obvious over the past twenty years that the Republican Party leadership knows neither who the enemy is nor do they have a firm and unalterable conviction in what the Republican Party stands for....

The Republican Party stood idly by and allowed themselves to be defined as the party of intolerance and inequity. The combined 12 years of George H.W. and George W. Bush, and their obsession with civility as well their refusal to forcefully respond to the most egregious of personal attacks combined with the Party's incoherent set of principles, validated and cemented in the public's mind the accusations hurled at the Republican Party by the Democrats and their sycophants in the media.

Yet the strategy of the left can be countered by an equally simple and effective tactic.  Use the same fairness and equality battering ram against them while forcefully and coherently responding to all their personal attacks as well as their omnipresent falsehoods and hypocrisy.  However this requires a commitment by the Republican establishment that it is the party of conservatism and a sobering recognition of the dangers the nation faces combined with an unwavering resolve to soundly and permanently defeat their political opponents.

The possibilities for the Republicans to go on a coordinated offensive using the fairness and equality cudgel, in language the low-information voter will understand, are endless....

The founders of this nation created a unique governmental structure in order to limit the supremacy of government.  However, with that structure there is an Achilles' heel.   For the government to function, because of the single member district structure, there can only be two major political parties vying for the votes of the people. When there is one party hell bent and succeeding in transforming the country and oppressing the people and the other party unwilling to forcefully challenge that effort, the future of the nation, as founded, is in serious jeopardy.

Instead of writing more "white papers" the Republican Party hierarchy needs to abdicate and turn over the reins to those willing to fight for the future of the American people before it is too late."
